ANORDINANCEAMENDINGANORDINANCECONCERNINGVIDEO
GAMINGTERMINALFEESCHARGEDBYTHECITYOFMOMENCE
WHEREAS,
TheCityCouncil of theCityofMomence, Illinois has an ordinance
concerning a video gaming terminal fee of four hundred dollars ($400.00) permachine
per year charged by theCityofMomence; and
WHEREAS
, Illinois PublicAct 96-34 created theVideoGamingAct (the “Act”), 230
ILCS 40/1, et seq., for the purpose of authorizing the operation of video gaming terminals
in licensed retail establishmentswhere alcoholic liquor is drawn, poured, mixed, or
otherwise served for consumption on the premises; and
WHEREAS,
theVideoGamingActmandated that the video gaming terminal license fee
be twenty-five dollars ($25.00) per year permachine; and
WHEREAS,
it is the intent of theCityCouncil of theCityofMomence, Illinois to
conformwith all Illinois StateStatutes; and
WHEREAS,
theCityCouncil of theCityofMomence, Illinois has determined that the
ordinance concerningvideo gaming terminal fees should be amended.
NOW, THEREFORE,
be it ordained by theCityCouncil of theCityofMomence,
Illinois as follows:
SECTION 1:
That Title 3, Chapter 4, Section 4, SubsectionC, of theCityCode of the
CityofMomence, Illinois is hereby repealed.
SECTION 2:
That there is hereby added to theCityCode of theCityofMomence,
Illinois, the following section under and in substitution for Title 3, Chapter 4, Section 4,
SubsectionC, hereinabove repealed.
3-4-4: FEES:
(C) For each video gamemachine, the license fee shall be twenty-five dollars ($25.00)
per year permachine.
SECTION 3:
The provisions and sections of this ordinance shall be deemed separable
and the invalidityof anyportion of this ordinance shall not affect the validityof the
remainder.
