ANORDINANCEADDRESSINGFENCES
WHEREAS,
theCityCouncil of theCityofMomence, Illinois, desires to ensure an
orderly and legal procedure in addressing fences; and
WHEREAS,
theCityCouncil of theCityofMomence, Illinois, has considered the fact
that fences should be addressed in theCityCode; and
WHEREAS,
theCityCouncil of theCityofMomence, Illinoiswishes to add to theCity
Code, specificallyunder a portion of theCode known asTitle 4, Chapter 8, Sections 1
through 6.
NOW, THEREFORE,
be it ordained by theCityCouncil of theCityofMomence,
Illinois as follows:
SECTION 1:
That Title 4, Chapter 8, Sections 1 through 6, are hereby added to theCity
Code of theCityofMomence, Illinois.
CHAPTER 8
FENCES
4-8-1: COMPLIANCEREQUIRED:
Every fence orwall hereafter constructed, installed, altered,maintained, removed or
demolishedwithin the city, shall complywith all applicable provisions of this chapter.
Existing fences orwallsmaybe continuedwithout change, provided the requirements
concerning fences orwalls in theCityCode are observed
4-8-2:DEFINITIONS:
For the purpose of this chapter, the following terms, phrases, words and their derivations
shall have themeaninggiven herein.When not inconsistentwith the context, words used
in the present tense include the future;words in the plural include the singular;words in
the singular include the plural; and theword "shall" ismandatorywhile theword "may"
is permissive.
FENCESORWALLS:A freestanding, upright structure, and shall be constructed of
wood, stone, brick, decorative concrete block, wrought iron, chainlink (with option of
slats ormesh affixed to the chainlink fence), products created to resemble thesematerials,
or a combination of anyof thesematerials.
