5-4-5: SPECIALASSESSMENTFORPAYMENTOFCOSTS:
The cityofMomence is adoptingmunicipal code section 65 IllinoisCompiledStatutes
5/9-2-4.5, which states:
Sec. 9-2-4.5.
Special assessment for payment of costs associatedwith certain ordinance violations.
(A)For purposes of this Section, "Code"means anymunicipal ordinance that requires,
after notice, the cuttingof grass andweeds, the removal of garbage and debris, the
removal of inoperablemotor vehicles, and rodent and vermin abatement.
(B) In addition to any othermethod authorized by law, if (i) a property owner is cited
with aCode violation, (ii) non-compliance is found upon reinspection of the property
after seventy two (72) hours for compliancewith an order to correct theCode violation
orwith an order for abatement, (iii) costs for services rendered by themunicipality to
correct theCode violation remain unpaid at the point in time that theywould become a
debt due and owing themunicipality, as provided inDivision 31.1 of Article 11 of the
IllinoisMunicipal Code, and (iv) a lien has been filed of record by themunicipality in the
office of the recorder in the county inwhich the property is located, then those costsmay
be collected as a special assessment on the property under thisDivision. Upon payment
of the costs by the owner of record or persons interested in the property, the lien shall be
released by themunicipality, and the release shall be filed of record in the samemanner
as the filing of notice of the lien.
SECTION 3:
The provisions and sections of this ordinance shall be deemed separable
and the invalidityof anyportion of this ordinance shall not affect the validityof the
remainder.
SECTION 4
: That this ordinance shall be in full force and effect after its passage,
adoption, and publication as required by law.
