ANORDINANCEAMENDINGANORDINANCEREGULATINGFENCES
WITHINTHECITYLIMITS
WHEREAS,
theCityCouncil of theCityofMomence, Illinois desires to ensure the
safety andwell beingof its citizens, inhabitants, and all other personswithin theCity
limits of theCityofMomence, Illinois; and
WHEREAS,
theCityCouncil of theCityofMomence, Illinois has established an
ordinance concerning fences as permitted obstructions; and
WHEREAS,
theCityCouncil of theCityofMomence, Illinois, has considered the fact
that the area a fencemayoccupy should be redefined; and
WHEREAS,
theCityCouncil of theCityofMomence, Illinoiswishes to amend theCity
Code, specificallyunder a portion of theCode known asTitle 9, Chapter 4, Section 2,
Subsection 5, entitled “PERMITTEDOBSTRUCTIONS”.
NOW, THEREFORE,
be it ordained by theCityCouncil of theCityofMomence,
Illinois as follows:
SECTION1:
That Title 9, Chapter 4, Section 2, Subsection 5, entitled “PERMITTED
OBSTRUCTIONS” of theCityCodeof theCityofMomence, Illinois ishereby repealed.
SECTION2:
That there is herebyadded to theCityCodeof theCityofMomence, Illinois
the followingparagraphunder and in substitution for Title 9, Chapter 4, Section 2,
Subsection5, of theCityCodeof theCityofMomence, Illinois hereinabove repealed.
9-4-2-5:PERMITTEDUSES:
The following shall not beconsidered as obstructionswhen locatedonorwithinyards
within residentiallyzonedareas:
Arbors and trellises.
Awnings and canopies.
Breezeways andopenporches (rear yards only).
Chimneys, not exceeding twopercent (2%) of thewidthof theyards.
Fences orwalls not over six feet (6’) inheight (rear yard, and sideyard from the rear point
of sidewall of principal buildingestablishing said sideyard); providedhowever, that the
posts andwoodenbraces face theyardbeingenclosed.
