ANORDINACEAMENDINGANORDINANCECONCERNINGREMOVAL,
ABATEMENT, ANDPAYMENTOFCOSTSOFOVERGROWNWEEDS,
GRASS, PLANTS,GARBAGE, DEBRIS, RODENTS, ANDVERMIN
WHEREAS,
TheCityCouncil of theCityofMomence, Illinois, has established an
ordinance concerning removal, abatement, and payment of costs, of overgrownweeds,
grass and plants; and
WHEREAS,
theCityCouncil of theCityofMomence, Illinois has determined that the
Ordinance concerning removal, abatement, and payment of costs of overgrownweeds,
grass and plants, should be amended to include the payment of costs of removal, or
abatement of garbage, debris, rodents, and vermin;
NOW, THEREFORE,
be it ordained by theCityCouncil of theCityofMomence,
Illinois, as follows:
SECTION 1:
That Title 5, Chapter 4, Sections 4, 5, and 6, of theCityCode of theCityof
Momence, Illinois, is hereby repealed.
SECTION 2:
That there is hereby added to theCityCode of theCityofMomence,
Illinois, the followingSections under and in substitution for Title 5, Chapter 4, Sections
4, 5, and 6, hereinabove repealed:
CHAPTER 4
WEEDS; BARBERRYBUSHES
5-4-4: REMOVAL;NOTICE:
It shall be the dutyof the chief of police, or his designee, to serve or cause to be served, a
notice upon the owner or occupant of anypremises, or post notice on such premise on
whichweeds, grass, or plants are permitted to grow in violation of the provisions of this
chapter. This shall also apply to the removal of garbage and debris, and the abatement of
rodents and vermin. If the person in possession of the real estate so served has not cut the
weeds, grass, plants, removed garbage and debris, or rodent and vermin abatement,
within seventy-two (72) hours, from the date of service, the city shall then proceed to
abate suchnuisance by cutting theweeds, grass, or plants, removinggarbage and debris,
move forwardwith procedures to abate rodent and vermin. Upon the city's completion of
the removal of theweeds, grass, plants, garbage, debris, or rodent and vermin abatement,
the city shall determine the number of hours, with aminimum of one hour, spent in
abating said nuisance, and the owner and occupant of the premises shall become and
remain jointly and severally liable for repayment of the city's costs and expenses. Any
personwho violates this section is guiltyof a pettyoffense as provided in this section and
as established in the list of fines and fees (1-4-1-B).
