ANORDINANCEADDRESSINGACLASSFLICENSE
WHEREAS,
theCityCouncil of theCityofMomence, Illinois, desires to ensure anorderly and legal
procedure in addressing consumptionof alcoholic beverages; and
WHEREAS,
theCityCouncil of theCityofMomence, Illinois, has considered the fact that an additional
categoryof alcoholic liquor license should be addressed in theCityCode; and
WHEREAS,
theCityCouncil of theCityofMomence, Illinoiswishes to amend theCityCode,
specifically under a portionof theCode known asTitle 3, Chapter 2, Section4, titled “CLASSIFICATION
OFLICENSES” andTitle 3, Chapter 2, Section9, titled “LICENSEFEES”.
NOW, THEREFORE,
be it ordained by theCityCouncil of theCityofMomence, Illinois, as follows:
SECTION 1:
That Title 3, Chapter 2, Section4, titled “CLASSIFICATIONOFLICENSES”, of theCity
Code of theCityofMomence, Illinois, is hereby repealed
.
SECTION 2:
That there is hereby added to theCityCode of theCityofMomence, Illinois, under and in
substitution for Title 3, Chapter 2, Section4, titled “CLASSIFICATIONOFLICENSES”
3-2-4:CLASSIFICATIONOFLICENSES:
There shall be six (6) classifications of licenses that shall permit the licensee to sell alcoholic liquor. Said
classifications of licenses shall be as follows:
(A)
ClassA: A classA license shall authorize the sellingof any and all kinds of alcoholic beverages,
either inpackages for consumption off of the premises or by the drink for consumptionon the
premises and shall allow the establishment issued the license to be open for business six (6) days
aweek,Monday throughSaturday. There shall be amaximumof seven (7) classA licenses only.
(B)
ClassB: A classB license shall authorize an establishment whichhas been issued anyother
classificationof license to sell alcoholic beverages ofwhatever kind and inwhatever form said
classification so authorizes onSunday. There shall be amaximumof thirteen (13) classB
licenses only.
(C)
ClassC: A classC license shall authorize the sellingof alcoholic beverages inpackages only for
consumptionoff of the premises and shall not authorize said establishment to sell liquor by the
drink to be consumed on the premises. There shall be amaximumof four (4) classC licenses
only.
(D)
ClassD: A classD license shall authorize the sellingof alcoholic beverages only in conjunction
with the service of food to said personordering the alcoholic beverage and shall not authorize the
establishment so issued a classD license tomaintain a portionof the establishment uponwhich
personsmaybe served alcoholic beverageswithout food. There shall be amaximumof four (4)
classD licenses only.
(E)
ClassE: A classE catering license shall authorize the selling of alcoholic beverages anywhere in
the citywhere the licensee is acting as a caterer, in conjunctionwithparties, or eventswhere the
licensee is also providing food services. During anyquarterlyperiod, the income the licensee
derives from the sale of food,must comprise at least 50 percent of the gross revenue of the
amount earned from the sale of food and alcoholic beverages at suchparties or events. In
addition to the other requirements of this section, a classE license shall onlybe issued to those
