of thisOrdinance is found invalid or unenforceable, it is the desire of theMayor andAlderman
for the courtmaking such finding to treat the remainingprovisions and alternate applications as
severable from the invalidityor unenforceability and to remain in full force and effect to the
maximum extent permitted by law.
Definitions. All capitalized terms not otherwise defined herein shall have the samemeaning
ascribed thereto in theAct, includingbut not limited to theBoard, VideoGamingTerminal and
LicensedEstablishment .
LicensedGambling. Section 3-2-21 of theCode is hereby stricken and replacedwith the
followingnew language:
3-2-21: UNLICENSEDGAMBLING, IMMORALITYPROHIBITED:
(A)
No licensee shall permit any illegal, disorderly or immoral practices upon
the licensed premises; and no person reputed to be a gambler or having
been convicted of gambling or having any connection with any illegal
alleged gamblinghouse shall be granted a license to sell alcoholic liquor.
(B)
Except to the extent licensed by the Board, no game of chance, gambling
or gamingdevice shall be kept or used in anypremises licensedhereunder.
Video gaming terminals may be operated in Licensed Establishments to
the extent permitted by the Video Gaming Act and the regulations of the
Illinois Gaming Board promulgated thereunder. The owner of a Licensed
Establishment where a Video Gaming Terminal is operated shall
conspicuouslypost the license for suchTerminal in viewof the public.
Section 1.
Licensed Games. Section 3-4-1 of the Code is hereby amended in the
manner described below:
3-4-1:LICENSEREQUIRED:
No person shall set up, keep or cause to be kept by his agent or servant any
shooting gallery, billiard, bagatelle, video game, pool or other kind of table or
place whatsoever on or at which games of skill or of chance are played, and for
the use of which, or privilege of playing thereon or thereat, any money or its
equivalent shall be required, paid or received without first obtaining a license
therefor in accordancewith the provisions of this chapter. This Chapter shall not
be construed to prohibit, restrict, regulate or otherwise license the operation of
Video Gaming Terminals in the manner described and permitted by the Video
Gaming Act, 230, ILCS 40/1, et seq., as amended, it being the intent of the City
for suchVideoGameTerminals to be outside the scope of thisChapter.
