ANORDINANCEVACATINGANALLEYAND
DIRECTINGATRANSFEROFTITLETOMUNICIPALTRUST&SAVINGSBANK
TRUSTNO. 2422
WHEREAS, the alley, whose legal description is shown onAppendixA, attached to and
made a part of thisOrdinance is no longer necessary formunicipal use; and
WHEREAS, theCitydesires to vacate that alley and to transfer ownership toMunicipal
Trust&SavingsBankTrustNo. 2422, owner of three properties adjoining the alley to be
vacated; and
WHEREAS, theCityhas determined that the dollar amount connectedwith preparing a
Plat ofVacation, and all buyer and seller closing costs and legal fees involvedwith the transfer
of title toMunicipal Trust&SavingsBankTrust No. 2422, will be adequate to compensate the
City for the transfer of the title to this alley.
NOW, THEREFORE, BE ITORDAINEDBYTHEMAYORANDCITYCOUNCIL
OFTHECITYOFMOMENCE, KANKAKEECOUNTY, ILLINOIS, as follows:
SECTION1. The alley legallydescribed is set forth onAppendixA attached to and
made a part of thisOrdinance is herebyvacated. Upon the payment ofmonies associatedwith
Plat ofVacation, legal fees, and closing costs, the title to this property shall be automatically
transferred toMunicipal Trust&SavingsBankTrustNo. 2422, owners of adjoiningproperty.
ThisOrdinance authorizes the preparation and execution of a quit claim deed of the propertyof
the vacated alley if requested by the new owner.
SECTION2. ThisOrdinance shall be in full force and effect after its passage by the
affirmative vote of at least three-fourths of theAlderman of theCity and its approval by the
Mayor and its publication in pamphlet form as provided by law. ThisOrdinancemaybe
recorded as evidence of a transfer of the ownership right of theCity.
