SECTION I: GENERALPROVISIONS
A.
The name of theEnterpriseZone shall be theKankakeeCountyEnterpriseZone.
B.
The area as described inExhibit “A” and graphicallydisplayed inExhibit “B” shall be
designated as theKankakeeCountyEnterpriseZone.
C.
TheEnterpriseZone area as designated herein requires approval of the Illinois
Department ofCommerce andEconomicOpportunity and as establishedherein shall be
in effect for 30 years from the date of adoption of this ordinance (the year of 2015),
unless decertified by theDepartment or repealed byordinance of the participating
government entities.
D.
The administration of theEnterpriseZone shall be under the jurisdiction of theVillage,
City, andCounty.
E.
Definitions
a.
“Department”means theDepartment ofCommerce andEconomicOpportunityof
theState of Illinois.
b.
“DesignatedZoneOrganization”means the organization or organizations
recommended by theAdministrativeEntity as authorized by theEnterpriseZone
Act.
c.
“EnterpriseZone”means theKankakeeCountyEnterpriseZone.
d.
“Industrial Property”means any real estate used primarily inmanufacturingor in the
extraction of processingof rawmaterials unserviceable in their natural state to create
new physical products ormaterials, or in the transportation or storage of raw
materials or finishedor partially finished goods in thewholesale distribution or such
materials or goods.
e.
“ManufacturingProperty”means any real estate used primarily in thematerial
staging and productionof goods used in procedures commonly regarded as
manufacturing, processing, fabrication, or assemblingwhich changes existing
materials into new shapes, newqualities, or new combinations.
f.
“Parties”mean the parties to theAgreement:KankakeeCounty, Village ofManteno,
andCityofMomence.
SECTION II: ENTERPRISEZONEADMINISTRATIVEBOARD
A.
Function&Duties. AnEnterpriseZoneAdministrativeBoard shall be created to act as a
steering committee to theZoneAdministrator. Advice rendered shall be determined by
a simplemajorityvote. The administrativeBoard shall perform the following functions
and dutieswith respect to theEnterpriseZone.
1.
Implement,monitor and update established goals and objectives;
2.
Establish procedures for the operation andmanagement of theZone, including
appeals processes, and recommend and advise on policies for the operation and
management of theZone and the administration and enforcement of the
Ordinance;
