RE: ESTABLISHMENTOFTHECITYOFMOMENCEENTERPRISEZONEAND
THEBOUNDARIESTHEREOF INTHECITYOFMOMENCE
WHEREAS,
theStateof Illinois signed into law the “IllinoisEnterpriseZoneAct” of
1982, 20 ILCS 655/1
et seq.
; and,
WHEREAS
, theCity of Momence is a participant in theKankakeeCountyEnterprise
Zone, which expires on July 1, 2016; and,
WHEREAS,
in 2012,
theStateof Illinois signed into law an amendment to the “Illinois
EnterpriseZoneAct”, 20 ILCS 655/1
et seq.
; and,
WHEREAS
, pursuant to the 2012amendment, enterprise zones that are scheduled to
expire in 2016 areallowed to submit applications for a newenterprise zone to the Illinois
Department of Commerce andEconomicOpportunity; and,
WHEREAS,
a public hearingwas held onOctober 23, 2014with respect to the
designationof parts of theCounty of Kankakee (the “County”) as anEnterpriseZone;
and,
WHEREAS,
it is the findingof thisCityCouncil that theestablishment of anEnterprise
Zonewithin boundaries hereinafter described is in the best interests of the city; and,
WHEREAS,
the area to beestablished as anEnterpriseZone is a contiguous area;
and,
WHEREAS
, the area to beestablished as anEnterpriseZone comprises aminimumof
one-half mile and notmore than 15 squaremiles; and,
WHEREAS
, theEnterpriseZonemeets the qualifications established inSection4of the
“EnterpriseZoneAct”; and,
WHEREAS,
it is necessary that a formal applicationbemade for approval of the said
designationof theEnterpriseZone to the IllinoisDepartment of Commerceand
EconomicOpportunity in accordancewith the findings set forth in thisOrdinance; and,
WHEREAS,
it is the findingof thisCityCouncil that theKankakeeCountyEnterprise
Zone is necessary to encourage industrial expansion and retention, andalso
commercial expansionand retention.
NOW, THEREFORE, BE ITORDAINED
byCityCouncil of Momence, Illinois, as
follows:

incorporatedhereinby reference andmadeapart hereof, as if fully set forth
below.
