ORDINANCENO. 802WHICHAUTHORIZEDTHE
EXECUTIONOFALOANAGREEMENTFROMTHE
PUBLICWATERSUPPLYPROGRAM
WHEREAS,
on October 5, 2015, the Corporate Authorities of the City of Momence adopted Ordinance
No. 802, anOrdinanceAuthorizingLoanAgreement; and
WHEREAS
, in the second Whereas clause in that Ordinance, there was a typographical error in that
reference was made to Section 3.1 of the Intergovernmental Cooperation Act, 5 ILCS 200/3.1 which was not the
correct reference; and
WHEREAS
, the correct reference which authorizes the City of Momence to operate a combined
waterworks and sewer system is 65 ILCS 5/11-139; and
WHEREAS
, that typographical error did not in any way harm the validity of Ordinance No. 802 but for
the purpose of correcting a typographical error, the Corporate Authorities wish to adopt another Ordinance to
perfectly clarify this point and the statutory authoritygranted to themby state law to operate a combinedwaterworks
and sewage system.
NOW THEREFORE, BE IT ORDAINED BY THE CORPORATE AUTHORITIES OF THE CITY OF
MOMENCE, KANKAKEECOUNTY, ILLINOIS, as follows:
SECTION 1.
OrdinanceNo. 802 adopted onOctober 5, 2015by theCityCouncil of theCityofMomence, is and the
same is hereby amended in that the firstWhereas clause of that Ordinance shall here and after read as follows:
WHEREAS
, theCityofMomence, KankakeeCounty, Illinois operates its publicwater supply system
(“the System”) in accordancewith the provisions of 65 ILCS5/11-139 and is allowed to borrow funds to support
that System under the Local GovernmentDebt ReformAct, 30 ILCS350/1 (collectively, “theAct”), and
SECTION 2.
With the exceptionof the single amendment provided for inSection1 of thisOrdinance, all terms and
conditions containedwithinOrdinance 802 are unamended and shall remain in full force and effect.
SECTION 3.
ThisAmendatoryOrdinance shall take effect upon its passage, approval and publication inpamphlet form
as provided by law.
