(I)
PENALTY
1. Any violationof theweight limitations set forth in thisChapter, any person, firmor
corporationwho or which violates, disobeys, neglects, fails to complywith, or resists
enforcement of, theprovisions of this chapter shall be finednot less than$50.00 nor
more than $750.00 for eachoffense. A separateoffense shall bedeemed committed
on each calendar day a violationoccurs.
or
2. For any violationof 625 ILCS 5/ 15-316, any person firmor corporation convictedof
such violation shall be finedanamount as provided in ILCSCh. 625, Act 5, §15-316(e)
as now in effect or as hereafter amended and in effect as of thedate of such violation.
and/or
3. For any violationof thedimensionandweight limitations set forth in625 ILCS 5/15-
102, 103, 107& 111, any person, firmor corporation convicted of such violation shall
be additionally finedanamount as provided in ILCSCh. 625, Act 5, §15-113as now in
effect or as hereafter amendedand ineffect as of thedateof the such violation.
4. In addition to seekinga fine, as herein above provided, the CityAttorneymay institute
any proper action in thename of theCity of Momence to enjoin the violation of any
provision of thisChapter or to collect any damages allowed by law, includingbut not
limited to liability for damages as provided in ILCSCh. 625, Act 5, §15-318as now in
effect or as hereafter amendedand ineffect as of thedateof theunderlying violation.
5. Whenever any vehicleor combinationof vehicles is operated in violation of this
section, the owner and/or driver of such vehicle shall be deemedguilty of such
violationand either or both the owner anddriver of such vehiclemay beprosecuted for
such violation.
SectionThree:
That all ordinances and parts of ordinances in conflict with or
inconsistent with theprovisions of this ordinance arehereby repealed to theextent of
any such conflict or inconsistency.
SectionFour:
That if any part or portion of this ordinance shall bedeclared
invalid by a court of competent jurisdiction, such partial invalidity shall not affect the
