ANORDINANCEAMENDINGREGULATINGSIZEANDWEIGHTOFVEHICLES
WHEREAS,
theCityCouncil of theCityofMomence, Illinois is chargedwith the continued administration and
oversight of theCityCodeBook; and
WHEREAS,
theCityCouncil of theCityofMomence, Illinois has established anordinance regulating size and
weight of vehicles, and the fees associated therein; and
WHEREAS,
theCityCouncil of theCityofMomence, Illinois, has determined that fees associatedwith the
regulationof size andweight of vehicles should be updated; and
WHEREAS,
theCityCouncil of theCityofMomence, Illinois, has given approval to establish separate funds for
holding and disbursement of funds generated from the regulationof size and weight vehicle fees; and
WHEREAS,
theCityCouncil of theCityofMomence, Illinois, has resolved that fees associatedwith the regulation
of size andweight of vehicles should be split sixtypercent (60%) for street repair, and fortypercent (40%) for police
department equipment purchases; and
WHEREAS,
theCityCouncil of theCityofMomence, Illinoiswishes to add to theCityCode, specificallyunder a
portionof theCode to be known as Title 7, Chapter 1, Section 10, Subsection J, titled “USEOFREVENUES
RESTRICTED”.
NOW, THEREFORE,
be it ordained by theCityCouncil of theCityofMomence, Illinois, as follows:
SECTION 1:
That there is hereby added to theCityCode of theCityofMomence, Illinois, in Title 7, Chapter 1,
Section10, Subsection J, titled “USEOFREVENUESRESTRICTED”.
7-1-10:REGULATINGSIZEANDWEIGHTOFVEHICLES:
(J)USEOFREVENUESRESTRICTED:
Separate accountingprocedures shall be established for the collection, holding and disbursement of revenues
generated under this chapter. Sixtypercent (60%) of revenues thus generated are to be used solely for street repairs.
Fortypercent (40%) of revenues thus generated are to be used for PoliceDepartment equipment purchases.
SECTION 2:
The provisions and sections of this ordinance shall be deemed separable and the invalidityof any
portionof this ordinance shall not affect the validityof the remainder.
SECTION 3
: That this ordinance shall be in full force and effect after its passage, adoption, and publication in
pamphlet form, as required by law.
