ANORDINANCECONCERNINGSIDEWALKDININGAREAS
WHEREAS,
theCityCouncil of theCityofMomence, Illinois is chargedwith the continued administration and
oversight of theCityCodeBook; and
WHEREAS,
theCityCouncil of theCityofMomence, Illinoiswants to promote outdoor dining in the downtown
area; and
WHEREAS,
theCityCouncil of theCityofMomence, Illinois, aspires to enhance the economic and social vitality
of the downtown area, promote pedestrian and retail activity, allow for the use of public sidewalks for outdoor
dining, ensure the public’s use of the sidewalkswill not be significantly impaired by suchdining; and
WHEREAS,
theCityCouncil of theCityofMomence, Illinoiswishes to add to theCityCode, specificallyunder a
portionof theCode that will be known as Title 3, Chapter 10, Sections 1 through6.
WHEREAS,
theCityCouncil of theCityofMomence, Illinoiswishes to amend theCityCode, specificallyunder a
portionof theCode known as Title 5, Chapter1, Section 1, Subsection2, titled “ALCOHOLICLIQUOR.”
NOW, THEREFORE,
be it ordained by theCityCouncil of theCityofMomence, Illinois, as follows:
SECTION 1:
That there is hereby added to theCityCode of theCityofMomence, Illinois, inTitle 3, aChapter 10,
andSections 1 through6.
Title 3
Chapter 10:DOWNTOWNSIDEWALKDINING:
3-10-1: PURPOSE:
TheDowntownSidewalkDiningPermit is intended to facilitate outdoor dining in the downtown area; to create an
active streetscape, enhance the economic and social vitalityof the downtown area; to promote pedestrian and retail
activity; to allow for the use of public sidewalks for suchoutdoor dining; to expedite the approval of such facilities
while ensuring that the public’s use of the sidewalkswill not be significantly impaired by suchdining; and to
prevent any adverse impact to adjacent properties from such dining.
3-10-2: PERMITEDAREAS:
SidewalkDining shall be permitted onlyupon a propertywhich is locatedwithin theDowntowndistrict and zoned
B-1.
3-10-3:ALCOHOLICLIQUOR:
No alcoholic beverages shall be sold, served, consumed, or possessed by anypersonwithin a sidewalkdining area
unless the sidewalkdining area is bordering the building face, and the premises has either a classA, B, orD liquor
license.
