1. Restriction: No person shall operate and no person, including a parent, shall permit another to operate a
motor vehiclewithin the corporate limits of theCity in violation of the restrictions set forth in thisChapter.
2. Penalty: Any person found guilty by a court of law of violating this Subchapter (K) shall be fined in the
mandatory amount of SevenHundred FiftyDollars ($750.00).

Zero Tolerance With Respect to Alcohol Use
. It shall be unlawful for any underage person to have any
alcohol of any level detectable by observation or blood/alcohol testing in the person’s system. If the blood/alcohol
level is less than .05milliliters of alcohol per liter of blood, then it shall be a defense that the alcohol was acquired
pursuant to the exceptions set forth in Paragraph (C) of this Section. Such defense may be established by clear and
convincing evidence by the testimonyof the adult providing the alcoholic liquor.

Possession of Alcohol By Underage Persons
It shall be unlawful for any person under the age of twenty-
one (21) to possess, dispense, or consume alcoholic liquor. Any person to whom the sale, gift or delivery of any
alcoholic liquor is prohibited because of age shall not purchase, accept a gift of such alcoholic liquor or have such
alcoholic liquor in his possession.
3-2-32: VIOLATIONSANDPENALTIES
Violation of any provision of this Chapter may be prosecuted as an administrative offense before the Commissioner
if the offender is the holder of a license issued by the Commissioner, and independently in a court of law as a
violationof theCityCode.
A. General.
Unless another penalty is set forth in this Chapter, every person found guilty of a violation of any of the provisions
of this Chapter by the Commissioner shall be subject to an administrative penalty of not more than Five Thousand
Dollars ($5,000.00) for each offense. A separate offense shall be deemed to have been committed on each day
during or onwhich a violation occurs or continues. Any fines set forth in this chapter shall be assessed regardless of
whether the violator is convicted or placed on supervisionby the court.
B. SubstanceAbuse.
If the offense is related to alcohol or substance abuse and the offender is under twenty-one (21) years of age, the
court or administrative adjudication hearing officer may assign the offender to a drug and alcohol education and
abuse counseling program that is licensed by the IllinoisDepartment of Alcohol and SubstanceAbuse and requires a
