In caseswhere the

is reimbursing the

, obligations of the

shall cease immediatelywithout penalty or further
payment being required if, in any fiscal year, the IllinoisGeneral Assembly or applicableFederal Funding source fails to appropriate
or otherwisemakeavailable funds for thework contemplatedherein.

All projects for the construction of fixedworkswhich are financed inwholeor in part with funds provided by thisAgreement and/or
amendment shall be subject to thePrevailingWageAct (820 ILCS 130/0.01 et seq.) unless the provisions of that Act exempt its
application.
