ANORDINANCEREZONINGPROPERTYATTHE
SOUTHWESTCORNEROFDIXIEHIGHWAY/5

WHEREAS, a 225’ x225’ parcel of property at the southwest corner ofDixieHighway/5
th
Street has
historicallybeen utilized for public purposes and owned by a SchoolDistrict; and
WHEREAS, that propertyhas been sold for commercial redevelopment; and
WHEREAS, the newOwner of that propertyhas sought a rezoningof the parcel of property; and
WHEREAS, Section9-1-12 of theMomenceCode provides that any area indicated on theZoningMap as a
public school site shall, when the use of the area is discontinued, be automatically zoned to themost restricted
adjoiningdistrict until appropriate zoning is authorized by the CityCouncil; and
WHEREAS, the property inquestion is adjacent to landwhichwould be residential innature; and
WHEREAS, the newOwner of the propertyhas requested rezoningof the property to theB-2 category
under the ZoningOrdinance; and
WHEREAS, the PlanCommissionof theCityofMomence held a public hearingonThursday, August 20,
2015, and recommended to theCityCouncil that the rezoningbe granted;
NOW, THEREFORE, BE ITORDAINEDBYTHEMAYORANDCITYCOUNCILOFTHECITYOF
MOMENCE, KANKAKEECOUNTY, ILLINOIS, as follows:
SECTION 1: The parcel of land comprised of a parcel of 225 feet by225 feet on the southwest corner of
DixieHighway/5
th
Street with the address of 415NorthDixieHighway, withPINNo. 06-10-13-416-001, be hereby
rezoned frompublic use or temporary residential zoning to the commercial B-2Zoning category. TheZoningMap
of theCityofMomence shall be amended to show this change in zoning. The zoning change shall be limited to the
225’ x225’ parcel, and the remainder of the property, which formerlywas utilized for school purposes, shall remain
zoned in accordancewith the ordinance relating to non-used former school property. Requests for changes in the
zoningof suchproperty from themost restrictive zoning category adjacent thereto shall be required if another
zoninguse of that property is sought. The zoning change requested herein is for the purpose of constructing a
convenience storewith gasoline pumps, but the zoning change hereingrantedwould permit, in compliancewith all
other ordinances, any other permittedB-2 use.
SECTION 2: ThisOrdnance shall be in full force and effect upon its passage, approval and publication in
pamphlet form as provided by law.
