ANORDINANCEAMENDINGANORDINANCECONCERNINGPROHIBITED
CONDUCTBYPEDDLERS/TRANSIENTMERCHANTS
WHEREAS,
theCityCouncil of theCityofMomence, Illinois is chargedwith the continued administration and
oversight of theCityCodeBook; and
WHEREAS,
theCityCouncil of theCityofMomence, Illinois has established anordinance regarding
peddler’s/transientmerchant’s code of conduct; and
WHEREAS,
theCityCouncil of theCityofMomence, Illinois has concluded that a banon peddlers/transient
merchants not being allowed to engage in their business onSundays and state or national holidays, should be
amended to allow said business; and
WHEREAS,
theCityCouncil of theCityofMomence, Illinois has determined that certain subsections of the
“PROHIBITEDCONDUCT”
Section, should be amended; and
WHEREAS,
theCityCouncil of theCityofMomence, Illinoiswishes to amend theCityCode, specificallyunder a
portionof theCode known as Title 3, Chapter 5, Section 8, SubsectionH, titled “
PROHIBITEDCONDUCT”.
NOW, THEREFORE,
be it ordained by theCityCouncil of theCityofMomence, Illinois, as follows:
SECTION 1:
That Title 3, Chapter 5, Section 8, SubsectionH, of theCityCode of theCityofMomence, Illinois, is
hereby repealed.
SECTION 2:
That there is hereby added to theCityCode of theCityofMomence, Illinois, under and in
substitution for Title 3, Chapter 5, Section 8, SubsectionH.
3-5-8: PROHIBITEDCONDUCT:
(H)No person shall engage in the business of peddler prior to twelve o’clock (noon), (12:00) P.M., and later than
five o’clock (5:00) P.M. onSunday.
SECTION 3:
The provisions and sections of this ordinance shall be deemed separable and the invalidityof any
portionof this ordinance shall not affect the validityof the remainder.
SECTION 4:
This ordinance shall be in full force and effect from and after its passage, approval, and publication as
required by law.
