TRANSFEROF
OWNERSHIPAGREEMENT
This is an agreement by and between the City of Momence (hereinafter the “City”), and former Momence Police
Officer Raymond T. Navratil. The parties are desirous of working out mutually agreeable arrangements of the
retirement of theCity’s canine dog, Pete to his handler, formerMomence PoliceOfficer RaymondT. Navratil.
1.
The parties hereby agree that, effective after the City Council approves this agreement on July 7, 2014,
Petewill be retired from service for theCity.
2.
As a result of the retirement, the City agrees to transfer ownership of Pete to former Momence Police
Officer Raymond T. Navratil at no cost. Mr. Navratil understands and agrees that the City offers no
warranty as to the current or future conditionof healthof Pete;Mr. Navratil agrees that to accept ownership
of Pete “as is” and that he is taking full responsibility for any and all costs associated with the care and
maintenance of Pete. This transfer means that all ownership and rights after July 7, 2014 belong to Mr.
Navratil.

Mr. Navratil agrees that he will not put Pete into service as a canine drug/patrol dog for any entity at any
time in the future, including actual use in narcotics searches, detection or patrol functions, as well as any
training associated with narcotics searches, detection of patrol functions. Mr. Navratil agrees not to sell
Pete for profit, loan Pete out, or give him away, if the purpose of such transfer is for the purpose of Pete
engaging in narcotics detection, searches or patrol functions.

Mr. Navratil agrees that Pete’s certification for conducting narcotics detection, searches or patrol functions
will expire upon Pete’s retirement from service with the City on July 7, 2014. Mr. Navratil agrees that he
will not attempt to re-certify Pete for narcotics detection, searches and patrol functions, and will not offer
Pete’s services to any private or public entity, or personally use Pete for narcotics detection or patrol
functions.

Mr. Navratil agrees to return any and all Departmental property issued for use with the canine drug/patrol
dogs, at the directionof theChief of Police.

Mr. Navratil agrees to hold the City ofMomence harmless for any claimmade as the result of any contract
liability, or incident, or occurrence involving Pete following the transfer of ownership to him, and also
agrees to file no claim of any kind, including, but not limited to, a lawsuit, Fair Labor Standards Action
(state or federal), or any other claim or suit arising out of Pete’s service to the City, Pete’s retirement as a
canine drug/patrol dog from the City, or Mr. Navratil’s claim for salary or benefits for prior care and
maintenance of Pete.
7.
Mr. Navratil agrees not to retrainPete for other police-related services for the purpose of financial gain.

This document is the full and complete agreement between the parties regarding this matter. The parties’
signatures below constitute consent to the Agreement and Transfer of Ownership of Pete toMr. Raymond
T. Navratil.
