RESOLUTIONOFTHECITYOFMOMENCE
REGARDINGAPPEALSFROMADECISIONOFTHE
LIQUORCONTROLCOMMISSIONER
WHEREAS
, the Illinois Liquor Control Act, 235 ILCS 5/7-9, provides that if a municipality has adopted
an appropriate resolution, then
an
appeal from a decision of the Local Liquor Control Commissioner to the Illinois
Liquor Control Commission shall be limited to a review of the official record of the proceedings of such Local
Liquor Control Commissioner; and
WHEREAS
, theMayor andCityCouncil have determined that it is in the best interest of the health, safety,
andwelfare of the City, that such appeals shall be on the record of the proceedings before the Local Liquor Control
Commissioner;
NOW THEREFORE BE IT RESOLVED
, by the Mayor and City Council of the City of Momence as
follows:
Section1:
The foregoing recitals are incorporatedherein andmade a part hereof.
Section2:
In any case of an appeal to the Illinois Liquor Control Commission from a decision of the
Local Liquor Control Commissioner of the City ofMomence, the appeal shall be limited to a review of the official
recordof the proceedings of theLocal Liquor Control Commissioner.
Section3:
This Resolution shall be effective immediately upon passage, approval and publication
according to law.
