(G)
Determination byhearingofficer.
1.
At the conclusion of the hearing, the hearingofficer shallmake a
determination on the basis of the evidence presented at the hearing, as to
whether or not a code violation exists. The determinationmaybe in
writing, andmaybe designated as findings, decision, and order.
2.
Amonetary sanction for a violation under this section shall not exceed the
amount provided in65 ILCS 5/1-2-1 et seq., as amended. A copyof any
finding, decision, and order shall be served on the defendantwithin five
(5) days after it is issued. Amonetary sanction for a violation under this
section shall not exceed penalties, as provided in theCityofMomence
fine scheduleTitle 1, Chapter 4, Section 1. Furthermore, a penaltymay
include, or consist of, a requirement that the defendant perform some
reasonable public servicework.
(H)
Reviewunder administrative law.
1.
The determinationof the hearingofficer shall be subject to review in the
circuit court of the county. The provisions of theAdministrativeReview
Law, 735 ILCS 5/3-101 et seq., as amended, and the rules adopted
pursuant thereto, shall apply to and govern every action for the judicial
reviewof the findings, decision, and order of a hearingofficer under this
section.
2.
Any fine, other sanction, or costs imposed, or part of any fine, other
sanction, or costs imposed, remainingunpaid after the exhaustion of, or
the failure to exhaust, judicial reviewprocedures under theAdministrative
ReviewLaw, shall be a debt due, and owing the city, and, as such,maybe
collected in accordancewith applicable law, andmay result in the
municipality’s filingwith the State of Illinois LocalDebt Recovery
Program (LDRP),
SECTION 4:
The provisions and sections of this ordinance shall be deemed separable
and the invalidityof anyportion of this ordinance shall not affect the validityof the
remainder.
SECTION 5
: That this ordinance shall be in full force and effect after its passage,
adoption, and publication in pamphlet form, as required by law.
