ANORDINANCEAMENDINGANORDINANCEREGARDING INBOUNDGRAINVEHICLES
WHEREAS,
Section11-1-1 of the IllinoisMunicipal Code grants tomunicipalities the authority to pass
and enforce all necessarypolice ordinances; and
WHEREAS,
Section11-80-2 of the IllinoisMunicipal Code grantsmunicipalities the authority to regulate
the use of the streets; and
WHEREAS,
Section15 of the IllinoisVehicleCode grantsmunicipalities the authority to regulate the size
andweight of vehicles.
WHEREAS,
theCityCouncil of theCityofMomence, Illinois is concerned about the efficient deliveryof
grainby local farmers; and
WHEREAS,
theCityCouncil of theCityofMomence, Illinoiswishes to amend theCityCode,
specifically under a portionof theCode that will be known asTitle 7, Chapter 1, Section10, SubsectionK.
NOW, THEREFORE,
be it ordained by theCityCouncil of theCityofMomence, Illinois, as follows:
SECTION 1:
That there is hereby added to theCityCode of theCityofMomence, Illinois, inTitle 7, Chapter 1,
Section10, SubsectionK titled “LOCALFARMER’S INBOUNDGRAINVEHICLES”.
7-1-10:REGULATINGSIZEANDWEIGHTOFVEHICLES:
(K) Local Farmer’s InboundGrainVehicles:
1. For the periodofAugust 1

throughDecember 15
th
of each calendar year, all inbound local farmer’s vehicles,
whose primarypurpose onCityofMomence streets is to deliver grain toOrrGrain, Inc. located at 500N. Railroad
Avenue inMomence, Illinois, mayuse the following route; FromDixieHighway, turn east onRiver Street, then
northonChocolate Street toWashingtonStreet, turn east onWashington street toRailroadAvenue, northon
RailroadAvenue toOrrGrain, Inc.
2. At no timewill anyvehicle be allowed to use this routewhen exitingOrrGrain, Inc. All outbound semi-tractor
trailersmust useRailroadAvenue to Industrial Drive as ameans of departing fromOrrGrain, Inc. No provisions of
this ordinance shall allow for any vehicle to be stopped on, or obstructing anypart of the roadway, as defined in the
IllinoisCompiledStatutes.
SECTION 2:
The provisions and sections of this ordinance shall be deemed separable and the invalidityof any
portionof this ordinance shall not affect the validityof the remainder.
SECTION 3
: That this ordinance shall be in full force and effect after its passage, adoption, and publication in
pamphlet form, as required by law.
